Anwyl Construction Company Ltd (Anwyl) and any other Anwyl group companies understands that your privacy is important to you and that you care about how your personal data is used and shared.

We respect and value your privacy and will only collect and use personal data in ways that are described here and in a manner that is consistent with our obligations and your rights under law.

Please read this Privacy Policy carefully and ensure that you understand it. Your acceptance of our Privacy Policy is deemed to occur upon your first use of our website or social media pages. If you do not accept and agree with this Privacy Policy, you must stop using our website(s) and social media pages immediately.

Data protection law

All data collected by us either in person, via our website or by any Anwyl representative over the telephone, by letter/post or by email.

Our website(s) is operated and controlled by us and designed, hosted and supported by Red-fern Media.

Our website(s) and social media pages may contain links to other website(s). Please note that we have no control over how your data is collected, stored or used by other website(s) and we advise you to check the privacy policies of any such website(s) before providing any data to them.

Your rights

As a data subject, you have the following rights under the GDPR, which this policy and our use of personal data have been signed to uphold

• The right of access to the personal data we hold about you
• The right to rectification if any personal data we hold about you is inaccurate or incomplete (please contact us using the details in point 13)
• The right to be forgotten, i.e. the right to ask us to delete any personal data we hold about you. See Point 5 for how long we will hold your data.
• The right to restrict (i.e. prevent) the processing of your personal data
• The right to data portability (obtaining a copy of your personal data to re-use with another service or organization)

What data do we collect?

Depending upon your interaction with us, we may collect some or all of the following personal, and non-personal data:

a) Name and contact information such as email addresses, postal address and telephone numbers.

c) The data and time of the visit and how long you remained on our website(s), along with the referral URL, if applicable
d) The pages visited on our website(s)

How do we use your data?

All personal data is process and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. We will comply with our obligations and safeguard your rights under the GDPR at all times. For more details on security, see point 7.

Our use of your personal data will always have a lawful basis, either because it is necessary to perform a contract with you, because you have consented to our use of your personal data (e.g. by subscribing to emails) or because it is in our legitimate interests.   i. Supplying our products and services to you (please note that we require your personal data in order to enter into a contract with you)

  ii. Replying to contacts from you via any means

  iii. To monitor customer satisfaction by way of customer service surveying

With your permission and/or where permitted by law, we may also use your data for marketing purposes, via social media, which may also include contacting you by email, telephone and/or post with information, news and offers on our products and services. We will not, however, send you any unsolicited marketing or spam and will take all reasonable steps to ensure that we fully protect your rights and comply with our obligations under the GDPR and the Privacy and Electronic communications (EC Directive) Regulations 2003.

You have the right to withdraw your consent to us using your personal data at any time and to request that we delete it.

We do not keep your personal data for any longer than is necessary in light of the reasons(s) for which it was first collected. However, we are sometimes required to retain your personal data for a set period of time. Where there is no legal obligation to hold your data for longer, we will keep your data for 2 years, unless you opt out during this time.

Some specific examples include, but are not limited to:

• Property purchases – at least the duration of your 10 year NHBC warranty
• Direct marketing – up to 2 years
• Other data – for up to 6 years in line with the statute of limitations

How and where do we store your data?

Data will only be stored in the UK.

We are committed to protecting your personal information and implement appropriate technical and organizational security measures to protect it against any unauthorized or unlawful processing and against any accidental loss, destruction or damage

Do we share your data?

We do not sell any of your personal information to third parties. We also do not share or disclose any of your personal information with third parties other than for the purposes specified in this policy or where there is a legal requirement, for example;

• In certain circumstances, we may be legally required to share certain data held by us, for example, where we are involved in legal proceedings, where we are complying with legal obligations, a court order or a governmental authority.
• As part of the reservation, exchange and legal completion process when buying an Anwyl home, we may be required to share certain information with Solicitors, Financial Intermediaries, Independent Financial Advisors and Help to Buy agents.
• After you have completed the process of purchasing a home from Anwyl Homes, we will pass personal information to other parties as necessary, to allow them to provide our after-sales support service. This will include subcontractors to fix faults and provide emergency call-out services.
• To facilitate the provision of warranties with a property purchased from us
• To notify utility suppliers and local authorities about your new property and any property we have purchased from you in part exchange
• To notify you about changes to our services and/or updates regarding living on your development in line with our regulatory obligations to do so.
• From time to time we may share your personal data with a third party in order to monitor customer satisfaction, including the processing of customer satisfaction surveys

What happens if our business changes hands?

We may from time to time, expand or reduce our business and this may involve the sale and/or transfer of control of all or part of our business. Any personal data that you have provided will, where it is relevant to any part of our business that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by us.

In the event that any of your data is to be transferred in such a manner, you will not be contacted in advance and informed of the changes.

How can you control your data?
